A mutual consent divorce is filed only after both the parties agree not to level any allegations against each other. 

The one what you have stated here cannot mentioned in the mutual consent divorce and the court will ask you to file a contested divorce case on the grounds of cruelty if such grounds are pleaded as reason for divorce. 

Under Sec. 13-B, A s*xless marriage is not a ground for divorce.  There must have been no s*xual activity for at least a year.  Courts need strong evidence for assertion.
