Our EC term is expiring on 30.04.20. Elections shall be held before the expiry of term. The EC meeting to be held on last week of March 2020 has been postponed due to Covid19. We have provision in bye-law that in the event of extraordinary circumstances, if elections are not held, the EC can postpone the elections for further period of 6 months. Whether we or in order to call the EC meeting next month and declare the election process. What are the formalities to be carried out? Bali

Due to COVID, you can postpone it the same EC will continue till the new EC elected.

The election process can be initiated after lifting of lockdown and with prior information to Registrar in case of registered association as they may depute an observer for impartial conduct of such election as per laid down process.

CONSIDER THIS:
1. Conducting Election Proceedures and inviting member crowd for voting, would violate the Lockdown directives and be a prosecutable offence.

2. Publish a Notice to all members about the fact and postponment of Elections due to Covid-19 restriction directives.  Also inform the registerirng authority by enclosing this Notice.

I endorse expert advise of Mr. Hemant Agarwal, you are required to notify the fact of "lockdown" to the members as well as all concerned. However, immediatetly after the period of lockdown procees of elections must be taken up and completed within reasonable time / as per law/Rule / Memorendum/ Bye-Laws.
