Benami property

A Flat was bought by a man in the name of his mother in law and all the money for the flat was paid for by the man.

After sometimes he gets the flat transferred in his wife.s name.

Is this a benami transaction? Is there a possibility of flat cancellation by the concerned athority?

yes,this transaction comes under benami transaction and allotment of flat can be cancelled on certain circumstances , consult some local lawyer with full details of the case.

Benami property transaction being non cognizable, who can complain about a property being benami?

What is the authority that can confiscate the property?

Mr Ashish,

Thanx for the reply. Can authority who has allotted the property take action on its own to cancel the property, once it gets to know that the property smells of being benami.

Or somebody has to push it to take action?

Or one has to wait for the competent authority to be notified for the purpose of confiscation.

One last thing sir, once property is declared benami, how much is the threat of 3 years jail and fine. Or is it just on paper and nothing happens to persons declared as involved in benami transaction.

I would need your considered view on the matter.
