Bonus payable

Dear Sir/Madam, I am working for a Private Limited Company and one of my colleague approached to me to have a clarity on Bonus Payable whose Salary break up is Basic + DA - 20,700 , HRA - 8500 Conveyance of 5,200 Total Salary per Month is 34,579/- So, will he be eligible for Bonus.

It may be noted that as per Act No. 06 of 2016 employees drawing salary or wage exceeding Rs. 21,000/- per month are NOT entitled to get any bonus under the act.

The defination of SALARY OR WAGE means ALL remunations (Other than remuneration in respect of OT), capable of being expressed in terms of money, , which would , if the terms of employment, express or implied were fufilled, be payable to employee in respect ot any employment and includes DA.

Since the total wages +Salary exceeds Rs. 21,000/- in your case the bonus is not payable.
