its clear that he asked for blank cheque from me for account varification purpose and he asked that u send only blank cheque and i send only blank cheque this is a evidence that he asked for the blank cheque and i send the same

then who filled the cheque who signed the cheque

If  signature is not yours, then you have the remedy..

To use those transactions you have to speak the truth. The truth as per you is that you sent an unsigned completely blank cheque to him (for what ??... you know).

 

Since you have replied to notice, nothing much can be done now. Once you are summoned, you argue with the honorable court, before charges are framed, regarding cheque bearing not your signature.

 

Moreover, please try to file a Police Case under 420 / 406 and if police refuses, they will, then approach the court for direction. Hire a lawyer first.

thanx for reply should i lodge the police complaint now or wait for further action from other side as i have given the reply and asked for the photo copy of bounced cheque from them. As i wan to see who signed the cheque once i got the copy of cheque then i can go to the police with proof and tell them about the fraud. wht u suggest.

if the proceeding under section 138.of N.I act has been started in the lower court thn u cn apply for quashing in the high court...nd easily u gt achieve it....aftr that u cn start ur proceeding in your own way...bt ensure tht all legal document are with you so that there is no..problem in proceeding..

It is ok, if truely there is no debt that you owe to the payee for any bonafide transaction between you and you have not signed the cheque and if it is misused by forgery you can also take legal action against the complainant and claim damages.
