Cheque dishonoured by developer

Dear Sir,

I have paid token money of around 2 lacs to developer for constructing flat at Neral near Karjat in 2012. Agreement was not registered but only MOU was done with developer & he agreed to give the possession before March 14, however, building is not yet completed. As per MOU clause buyer has right to cancel the agreement & get the refund with 12% interest.  I asked developer to cancel the agreement as I do not wish to wait till building gets complete as there was no committment from developers side on completion date.  He asked me to wait for 2 months & then issued post dated cheque with full refund along with interest however, cheque got bounced.

Now developer is not contactable on phone, mobile.  What option do I have ?  Can I file a case against dishounour of cheque?  what is the process that I need to follow?

cause a legal notice and approach court of law for recovery of advance amount with interests

Best take help of a local lawyer give him notice and file a case in consumer court
