Child's custody after wife's re-marriage

I got mutually seperated from my wife 2 years ago. I'm still unmarried and looking for re-marriage. She has recently re-married and my 8 years old daughter is in her custody and staying with her mother. In our joint affidavit she has taken child's responsibility.  

I'm not at talking terms at all with ex-wife. She is not allowing me any access to my child, deliberately keeping her away from me and my family and I came to know from others they she is pouring hatred in child's mind against me. I haven't yet applied for child visiting rights.

I'm badly missing my child and want to raise her in my custody. I'm right now thinking of my daughter's custody since ex-wife has re-married.  I want to know what are the chances that I may get my child custody and what would be the basis for filling the application in court?


Should I wait for re-marriage till I get child my custody? Please advise.

Chances of getting girl child custody are bleak.  You opt for shared parenting plan.  Formulate good plan where you both have access to girl child.  Define responsibilities and expenses sharing and timing.  Give it to court and get it approved.  Though chances of getting custody of girl child are bleak file custody application stating your intention not to remarry at all and look after the girl child, court may not trun blind eye to such plea.

Why Dnt do think about your daughters future before divorce? Dnt you ever think before divorce you both can remarried what about your daughter? Step parents can never love child as real one. Chances of getting custody is very less. Instead of filing custody first applied for child visiting rights. As you say " In our joint affidavit she has taken child's responsibility." Let child live with her mother.
