CJI suggested the govt..for All India Judicial Service. What do you think about this and how can AIJS affect our judicial system?
N.K.Assumi (Advocate) 25 October 2009
See Article 312 of the Constitution as amended by the Constitutional amendment Act of 1976, sectionn 45 with effect from 3rd january 1977. But our Parliament has slept over it like a sleeping Lion. The CJI sugestions is a welcome steps. If introduced our judicial Officers can be posted anywhere in India like the Indian administrative services and Indian Police Services.

Mr. Murali pls raise your grouse in separate query for proper discussion.
Mr. Assumi raised this matter earlier also....and this issue was discussed at length.
if there is any such fresh proposal then it should be executed as soon as possible but the unfortunate aspect is the state governments are playing negative role.
politicians do play in a major role in judicial appointments at higher level....so the state govts. would not like to loose such an interference.
A Truthseeker ( A retired Indian citizen) 25 October 2009
judiciary is the last shelter of the people . when politicians to grind their axe take law into their own hands the judiciary is the only panacea. so, it is natural that the politicians would not loosen their grip over judiciary. the AIJS would weaken the position of the politicians as the lowest to highest strata of judicature would be politically neutral.
A Truthseeker ( A retired Indian citizen) 25 October 2009
AIJS would never be implemented oterwise the main fountainhead of power would be the CJI instead of the Prime Minister in a parliamentary democracy.
N.K.Assumi (Advocate) 25 October 2009
Take it for granted that Article 312 which speak about All India judicial service is just a piece of decrations like the Directive priniples of the State Policy. it will be our Elusive dream.

the anti corruption society is required .No doubt SCI is supreme commander for enforcement
but that means poor peopel are not need justice and tey can be thrown to bay of bengal what a good attittude. The basic fundamental rights are to be governed not for begging pl.
The issue any for human rights must be look in to as PIL by intiail stage not after death or not after 28 years or in my cae in the postal department now also there are no equal oppurtunities in any stage every thing after denial THE PRINCIPLES OF THE NATURAL JUSTICE SMASHED
THE EQUAL OPPURNITIES ARE NOT FOUND IT WAS REMOOVED SUCH WAY PL
UNABLE TO LIVE IN CORRUPTION SOCIETY

Absolute and unchecked power is more dangerous. The suggestion of CJI is important and a proper procedure shoudl definitely be evolved to make the supremacy of Rule of law.
