My father died recently.. I have two queries to be clarified.
(i) He had taken 2 policies in which he had nominated his mother as nominee who is no more… now my father’s father, i.e my grand father is still alive and he is asking for a share in the benefit… I heard from one of my friend that myself, my brother and my mother being the 1st class legal heirs of my father are the only entitled members to claim his benefits. Is this true? As he also has filed a suit against my family, I would like to understand what kind of stand will a civil court would take and as per which law?
(ii) Also there is another policy for which my grand father is the nominee... does it mean that he is the only entitled person to get the entire benefit, or my family members being listed under 1st class legal heirs can claim a share from the benefit. If I file a suit against my grand father, will my family get a share.
