Clarification

Can anyone please enlighten me about:

 

Whether the High Court can decide the issue which is seized of by the Supreme Court in any other case?  I shall be obliged if I get any authority in support please.

Hon'ble Bombay HC decided the question of restrospective levy on "Renting of Immovable Property" services (Service tax matter) against the assessees.  The assessees filed an appeal in the Hon'ble Supreme Court.wherein stay granted with the directions to pay 50 % of the tax and for remaining 50% bank guarantee.  

On an identical issue, there is another petition pending before the Hon'ble Bombay High Court.  can the Hon'ble High Court will be in a position to decide the petition or else can modify its interim order in accordance with the terms of Hon'ble Supreme Court's order mentioned above.

I shall be obliged if any authority in this regard is provided.  I would also like to know how to proceed in this matter.

I am studying this case in the academic interest.
