Closure of case after quash.

The criminal complaint against me and all accused was quashed by BHC. we submitted the certified copy of the order to the jmfc. However, instead of closing, he has just put another date in the system.

He has done this before. he hasn't been passing order and just putting dates. hence we had to go to BHC. 

What can I do?

Did you discuss the issue with your lawyer engaged in Trial / High Court ? If so, what is his/her opinion and advise ?

Whether the High Court quashing order has been supplied to JMFC and even then s/he has passed "some" order on the complaint ? If so, move a contempt of Court before concerned High Court against the Magistrate.

However, the facts posted are unconviencing and unbelievable.

Yes. Infact he is the one who informed me. He is confident that order will be passed on next date and we dont need to take any action. (He himself is bewildered with this). We have ourselves supplied a copy of High court order, certified, along with application, so that there's no 'procedural' issue. Judge smiled and accepted, and later just gave the next date.

As the case has been quashed by High court and the certified copy of the order has been filed before trial court you need not worry about the pendency of the case before the trial court.

The trial court cannot proceed with the case in any manner even if it is doing it with mala fide intention.
