Common wall disputes amongst neighbours

Common Wall Disputes amongst neighbours

Common wall disputes amongst  neighbours are common in India.

When a person starts construction, normally he pays (this is the practice) the 50% cost of the common wall to his neighbour who has constructed the common wall.

 

Queries:

What is the legal position in this respect?

What is the remedy if the person refuses to pay the cost as such?

On the common wall both owners have got equal rights.

If any one of the parties to common wall raises construction on the same without consent of other party,agrieved party can approach civil court for injunction.Both the parties have equal rights over the common wall
