Contents of documents-secondary evidence

We have filed declaration suit for ancesstor property .  We submitted certificed copy of simple mortgage deed executed with defendant in 1950 as document. However, defendant is denying the execution and claiming that this property is fallen to his share and asking us to prove the documents.

All the original executor and witness for the mortgage deed is died. This document is 70 years old. Original is with Defendant only since it is mortgage deed.

Please suggest how to handle this situation and prove the contents of the documents. 

Partition is oral 70 years back.

Documents required for filing of the declaration suit of a property

  • Original papers of the ancestral property.
  • Ownership proof.
  • Address proof.
  • Proof of illegal possession of the property by the other party.
