5] At the time of receiving chargesheet which is given free of cost to ‘each’ accused by ‘pp’ in court, sometime court asks accused whether they are guilty, normally accused say – not guilty. Check the charge sheet – it is also called ‘Final Report’ – there should be a table showing list of witnesses and documents – many times it is not given, tell court for any discrepancy in it.

 

Query :

 

Do the accused get - ONLY LIST of witness / a copy of the statements of these witness too ??

I got list of witness along with their statement + chargesheet copy . There is something called chargesheet summary also, i had to take it seprately with some cost.

 

Not sure if any copies of proof are provided as there was none in my case ;)

what cost ?? kahe ka cost ??

bribe / charge for certified copy ??

Certified copy charges around 150/-  (inlusive of everything :-) )

so this means, we do not get CS summary.

we have to apply for cert. copy.

I am not sure as a legal procedure we should get CS summary on the first date of trial or not , but atleast in my case i didnt get it.

 

Probably learned members can advise on this.

the IO asked me to come at the city of filing FIR on monday.

i m going.

he said - come on monday, i will file charge sheet in court & give u a copy.


does the IO gives a copy / its the court who gives the copy ??

As a procedure io can not give you CS legally, he can only submit it in court and then you will be handed it over on first day of trial . He may be expecting some KADAK currency notes from you by this favor. If he feels the case is false then at the most he will allow you to see the chargesheet.

 

At the most he will inform you that CS is filed , then move application for certified copy of it in person / via lawyer and get it from court.

true buddy, 

i dont want to see the CS in advance.

whatever is there, is gonna be there itself.

i will see only the copy received by the court.


thankfully, i m informed by the IO that CS is ready & the will file it in court when we go there. (as per him - my mom has to sign some documents & they need our photographs to file CS)

In my case Photograph and finger prints were taken when i was under arrest.  I am not sure if procedure is different if you have AB / NB ..

 

And yes photographs are very much needed which are affixed to paper to ensure that you are the same person which was arrested and nobody is making proxy (reminds me of my college times) ;) That too 3 photographs, left view , right view and front view with slate in hand  :-) ditto as shown in movies...

Strange... No finger prints and  picture of mine was taken!!! Is this rule different in different states? OR I not so good looking!!!!!!!

Court would provide you a full set ( copy) of chargesheet free of cost if anything from following list is missing you must point is out to the court through your lawyer.

This copy would include: 

  1. copy of FIR
  2. rough map of the house where crime took place
  3. copy of statement given by your wife (this should match with FIR) and other witness list and statement during investigation
  4. copy of case summery

if statement of wife is already there in FIR.


So, the question is : 

do the police also take a distinct, separate statement from wife ??
