Party in person in transfer petition at supreme court

Hi I wanted to argue Transfer petition at Supreme Court as Respondent in Person.

Can I get the format for applying as Respondent in person. 

And also the templet for filing I.A under the existing transfer petition.

To argue a Transfer Petition at the Supreme Court as a Respondent in Person, you'll need to follow a specific format.

Here's a general outline: Format for Respondent in Person: 1. *Title and Caption*: Start with the title of the case, followed by the caption "Transfer Petition (Civil) No. of 2023".¹

 2. *Parties*: Mention the names and details of the petitioner and respondent.

3. *Affidavit*: File an affidavit stating the facts of the case, the grounds for opposing the transfer petition, and any other relevant information.²

4. *Verification*: Verify the affidavit by signing it before a notary public or oath commissioner. Template for Filing I.A under Existing Transfer Petition:

For filing an Interim Application (I.A) under an existing transfer petition, you can follow this format: Interim Application (I.A)

1. *Title and Caption*: Use the same title and caption as the transfer petition.

2. *Parties*: Mention the names and details of the parties.

3. *Prayer*: Clearly state the relief sought through the I.A.

 4. *Grounds*: Provide the grounds for filing the I.A, including any new developments or changed circumstances.

Here's an example of how you can format your I.A: IN THE SUPREME COURT OF INDIA (CIVIL ORIGINAL JURISDICTION) INTERIM APPLICATION NO. ____ OF 2023 IN THE MATTER OF: TRANSFER PETITION (CIVIL) NO. ____ OF 2023 XXXXXX ….Petitioner VERSUS XXXXXX ….Respondent TO THE HON’BLE CHIEF JUSTICE OF INDIA AND HIS COMPANION JUSTICES OF THE HON’BLE SUPREME COURT OF INDIA. THE HUMBLE APPLICATION OF THE RESPONDENT ABOVE NAMED. MOST RESPECTFULLY SHEWETH:

1. That the present Interim Application is being filed in the existing Transfer Petition (Civil) No. ____ of 2023.

 2. That the respondent is seeking interim relief in the form of [state the relief sought].

3. That the grounds for filing this I.A are [state the grounds, including any new developments or changed circumstances].

It is a good idea to argue as party in person but you need to know the procedures to be followed for seeking permission.

For all such services you can engage the services of an advocate practicing in supreme court on the terms of the chosen lawyer.

If you want to argue in person, there are certain formalities to go through. 

You need to file an IA (interlocutory application) seeking permission to appear and argue in person. You need to file a xerox copy of your Aadhaar card or any other valid id. Verification affidavit. Notarised. Notary available within the campus of Supreme Court of India. There will be an interview by the staff of Supreme Court of India. It may be in person interview or telephonic interview by video call. They will ask your educational qualifications and work experience, just to satisfy themselves that you are capable of appearing in person. They will advise you to be polite abd respectful with the judges of Supreme Court of India. 

There is also a separate counter for party in persons in the Supreme Court of India. The Supreme Court staff in this counter will also explain the formalities to be followed. 

You go to Supreme Court of India and you will be able to get the formats in the xerox shops within the campus. 

Some people in the campus of Supreme Court of India may approach you on their own, but please be cautious. Many of them may not be qualified. 

You can also search on Google regarding party in person in Supreme Court of India. 

You may also file a counter affidavit, synopsis, list of dates and events from your side, if you think the petitioner has omitted any important details. You must file it in the form of a paper book. You must also send them a soft copy. 

When you file your counter affidavit and other material in a paper book, the staff at the party in person counter will go through them and find defects. You will have to close them at the earliest. 

You please book your ticket to New Delhi and go to Supreme Court of India. There is a metro station called Supreme Court. It was earlier called Paragathi Maidan metro station. The recently built Bharatha Mantapam and other things are also nearby. 

It is advisable to take some unofficial assistance from junior advocates there. 

The xerox shops within the campus may help you with the paper books filed by previous respondents, if they have them. You may also try your luck at the party in person counter. Usually they cannot share the paperbooks filed by other respondents. 

The procedures may be tedious and time-consuming. So, please be prepared. Plan for multiple trips. 

Do you have all the papers filed by petitioners / opponents in the Supreme Court of India? Do you have all papers filed in High Court and lower courts? They are most important.

Try searching on Google for party in person in Supreme Court or something like that. 

You can also search on Google for IA seeking permission to appear and argue in person. 

You may also visit the website of Supreme Court of India. 

But I strongly advise you to go to New Delhi and spend a couple of days in the campus of Supreme Court of India exploring the Party in Person counter, xerox shops within the campus, consulting junior advocates within the campus of Supreme Court of India. 

It is not merely the template of IA. There are so many other things that you need to know, paperbook, counter affidavit, synopsis, list of dates and events and so on. Synopsis and list of dates and events may be optional for respondents, if they are happy with the synopsis and list of dates and events furnished by the petitioners. But anyway, you need to present your own point of view in your own synopsis, counter affidavit and other things. 

Your own High Court advocate may be able to help you. Or, some advocates from your High Court or any other High Court may have gone to Supreme Court of India, and they may be knowing these things. 

It is always better to go to New Delhi and Supreme Court of India and find out from the people there. 

Try to get copies of paperbooks filed by other respondents in other cases. Usually they don't share such things. But you can try your luck. Contact junior advocates. 

Unless you are too busy, I suggest that you go to the campus of Supreme Court of India, and become familiar with the things there. 

You spend time at the party in person counter and interact with other parties in person. Find out how they are preparing their papers. Some of them will be accompanied by lawyers helping them. There will be other lawyers seeking work from you directly. You can gain useful information, but please be cautious. 

Wherever you are, you visit the law book shops in your city, you may find some books containing something about these templates. 

There are books on Supreme Court Practice and Procedure, but I do not know whether they contain these templates. 

Again, it is not merely the template of IA, there are other things that you need to become familiar with. 

You need to find out whether E-FILING is mandatory now. A couple of years ago, it was optional. 

Even if you do E-FILING, people will be forced to visit Supreme Court of India to resolve various issues. 

I will advise you to visit the Supreme Court of India. 

Everybody can enter the campus of Supreme Court of India, but the area where the judges sit and conduct hearings is a high security zone. Everybody cannot go there. You must become familiar with that also. The procedures keep changing. There will be very long queues to get entry passes to enter high security zone. There is a separate counter giving entry passes to parties in person, but even it may have a long queue if you go late. 

You need to become familiar with many things. I don't think it will be easy to walk in on the day of hearing.

Better take help of supreme court lawyer for drafting of application to appear in person in SC so that no legal  points are left.

Did you search on Google? 

I am giving below an Application for Permission to Appear and Argue in Person. 

It is filed in a Special Leave Petition filed by a Petitioner in Person. 

I think yours is a different kind of petition and you are a respondent. 

This is just to give you an idea. You need to make necessary changes. You need to do sufficient work and consult appropriate people in the Party in Person counter in Supreme Court of India, xerox shops in the campus, and any junior advocates unofficially. 

The application must also be accompanied by a notarised affidavit. Try to get the format in the campus of Supreme Court of India. Aadhaar card is required. 

The following is an actual application filed in Supreme Court of India, with some changes. Names and case numbers have been changed. Please use it only after consulting enough people.

It is ideal that you get the assistance of some advocate clerk familiar with the filing procedures in Supreme Court.
