Coop hou service society is taking illegitimate transfer fees, how take it back from them

Dear Sir/Madam, We hereby undersigned honorable members of the Garden Residency-1 (Garden Residency Co. Op. Hou. service society ltd. Reg no NDHN/A.H.M/Sa (Ha) 4768 dated 29/07/2011) living in Bopal, Ahmedabad. As we did not know the law of Co. Op. Hou. service society ltd previously that it cannot take transfer fees as well as other funds on the name of development fund. Society (office Bearers) have asked us all to deposit transfer fees of Rs 50,000 unlawfully from each of us who purchased resale home in the society. According to Gujarat Government registrar circular dated April, 28 2016 vide clearly guiding all cooperative service societies that cooperative housing service society does not have right to accept transfer fees & and if they still break the laws there will be a provision to take appropriate legal actions on the responsible office bearers. Now we have informed society office bearers that coop. hou. service society cannot take transfer fees from members as they do not have any kind of ownership and rights with them. Service society has to mainly deal with the routine maintenance work of the society only. we have forwarded above cited circular to them two months ago and tried to inform office bearers regarding this clause and made them thoroughly aware about nuances of the law. but they still they are refusing to return back the transfer fee taken illegitimately. Additionally, they usually misbehave and abusing the honorable members who advised them to govern society according to the government laws and rule book. even they are not following the required statutory obligations like annual audit of books of account of the society. when we ask them to share public documents like by-laws of the society they are completely denying it to making it available and asked us to go wherever you want to go to complain and threaten us. we would request you to kindly give order/direction to the society to follow rule book and refund the illegitimate transfer fees to all victim members with banking interest.
