Friends,
I am took some pictures, which i posted in registerd image sharing site (in my account) and these pictures are watermarked in my name, were posted on forum site like this one.
Some one posted these pictures on rival site, when i came to know, i issued legal notice to site owner to withdraw the picture, as he was taking commecial benifit out of these pics, those pages got about 15000 hits (some other pics too were on the site/forum, but my pics were first pictures of the event). They even discuss about me in the site.
Site owner defence is that it was "use submitted contents" pics therefore he is not liable, he has not withdrawn the pics since he is getting higher hits and advertisement revenue due to this.
Site and server is based in USA.
What are my options.
