Credit card debt following parents demise

Hello All,

I am seeking advice on my situation presented below and hoping i will get the right direction.

My father who was 65 years old passed away during the month of april 2017 with credit card outsrtanding of approximately INR 50,000. I have approached the bank for closure and blocking of his credit card along with a copy of the death certificate and and my fathers ID proof. However, i am being asked to settle the debt before applying for closure. while i am happy to pay the monthly EMI's and close with tenure, HDFC bank are unwilling to co operate. I am the legal heir however, there is no real estate left behind nor a will not any form of inheritance. I am seeing conflicting information online and so here i am seeking your advice.

What i want to know is if the bank is legally entitled to recover the debt even if i  am not the co signer nor the gurantor

If local BM has not acted let your own counsel specializing in consumer matters Write to MD of the bank;
