Crpc 311

if a witness is summoned under crpc 311 and if he chooses to not appear, will there be any problem to the witness? the witness is not direct party to the case but third party.

Bailable warrants of arrest shall be issued if you fail to attend the court after the service of summons on you to appear before the court as a witness .

Non bailable warrants of arrest shall be issued if you fail to attend the court after the service of the bailable warrants. In the event of this You shall be arrested and brought before the court to tender your evidence as a witness.
The court is empowered with vaste discretionary powers and can pass lenient orders in the above circumstances as it may deem fit.

ok thank you. what if the court summons are not reachable to the witness? say "witness unavailable" , "door lock", "witness not staying on the address anymore", etc. etc.

How and in which section of crpc can we ask the court to let the complainant come and record her statement? My wife is not attending the court in 498a case. Chargesheet has already been filed 2 years back?
