Deduction in deposit

Hi there,

I am staying in flat from last 3 years (with registered rent agreement) and now owner asked me to vacate flat and gave me 2 month notice.

I have a 4 yr old kid who enhanced his writing skills on walls (which i believe all kid of similar age group do). 

So, just wanted your expert advice one below:

1. Can owner deduct white wash charges from my security deposite? I am stying in te same flat from last 3 years and during that duration white wash job wasn't perfomed by owner.

2. Is it legal to collect security depoiste which is 3-4 times of per month rent? I think 1 month rent as security deposite is allowed.

3. And i think owner has to refund the security deposite the day and time tenant vacate the flat.

U have to brief us what the agreement states, if it is silent  on all the three queries ,you  can contradict , if it has any mentioning and you have agreed to it, then u have to go by that. Since it is a registered document it has more validity than a un  registered one and terms of reference do play lot of role in this.
