Refer the case of Chandra Prakash Vs Mohan Lal, 1984 All LJ 726. The question has been exhaustively dealt with while discussing the scope of section 439 of the Code. But as pointed out by Suresh, a bit of illustration is required, as you have not mentioned in what circumstances and in which Court you are appearing for bail.

Secondly, you have to see whether the prosecution has satisfy the Court that there are reasonable grounds for believing that the acused is guilty of an Offence punishable with death or imprisonment for Life. Even a Magistrate in such case will perfectly within his rights to enlarge the person on bail even though the accusation is of Murder. See the case of Ratan Singh Vital Singh Vs State ( Case of Dacoity ) 1959 Cr,Lj 723. There are some Classic case of Supreme Court but the above two mentioned cases will suffice.
