Dispute about the will

Dear All,

I have a query if you all can help me in this.

I am staying in a house which was bought by my grandfather  it is flat in a big society 2 BHK. After his death my grandmother got it transfer it on her name and while she was alive she transfered it her 2 daughters spinster who were staying with her ,also my father and we were satying in the same house. My uncle that is chacha my father elder brother was staying seperate with his family.

After the death of my grandmother my aunties got it transfered it on there name elder first name and younger second name. My elder aunt also expired  and the younger aunt got it transfreed it on her name, but my chacha gave a no objection letter to the society stating not to change the name as accoding to my grandmother will which he has he also has the share in this said flat. My younger aunt and even my dad is no more and society is not ready to transfer it on my name.

I am surving with my mother my 2 sisters my wife and my son.The new thing which i came to know after i came back to my home as i was away after i got married in 2004, i came back in 2009.

The new thing i came to know that my aunt had made a will on elder sister name who is a mentally retatrted child from birth ie spastic. After her death all the property ie flat and what ever she possesed will go to my another sister who is married.

She has come and told me to leave the house as it belongs to her according to the will and my mother is also supporting as mine is inter caste marriage.

What need to be done and how to tackle this please guide me as to who is right and do i have any right on that property.

I am jobless now due to layoff where i will take my family please advise and help me.

Hello Gul

Your case is very complicated since the ownership has been succeeded many times. First of all, you should try to talk to your sister and try to make her understand that you are her brother and are going through a very difficult time, and would be homeless without the house. If she does not agree and your family remains against you, then you might have to file a case in the court to demand your share in the property and get some compensation. Succession is a very complex issue and you will need all the legal assistance that you can get if you wish to get what is rightfully yours. You will need to explain all the details to me and show me the documents so that we can work out a decent strategy for you to adopt.
