Dvc case certified copy - need help

Hi Experts,

Today I got certified copies of DV complaint where my wife filed in MM court.

I saw MM Judge passed interim order 8,000 per month without my knowledge in Oct 2012.

It has been mentioned that respondant didn't file counter and hence passing order.

This happened Oct 2012.

I never got any such order or summons. When I asked bench clerk, he is telling

it is practice of MM Judge to pass interim order in DV cases, I am not the first case.

I got Summons to attend court (I have copy, on Aug 12, 2013).

Since order passed in Oct 2012, I was asked to pay arrears...

My Questions.

1) How can MM Judge pass order without checking whether summons served or not?

2) He mentioned that wife is not working...Actually she is working and getting 40,000. I have proofs
How can he conclude without asking respondent?

3) What is the best way to deal the case?

I am planning to go for appeal and produce proofs and along with summons copy...

Please advise...

you can go for appeal. it is your basic duty to enquire about the case. now no law and order prevails in this country, women enjoys most right they are considered too powerful in courts better you go for outside settlement

Hi,

Thanks for inputs. I tried settlement through mediators and B**ch is demanding 20 Lakhs..She wants to harrass.

She planned in such way that get Interim order in Oct 2012 and not to send any summons till Aug 2013 and wants to extract lump sum amount.

 

My question that comes now, I saw many forums that appeal period is 30 days.

Order says Oct 2012 and I came to know by Summons this month Aug 12.  How session or high court consider appeal period?

 

Order date or from Summon date?
