Employer terminated with immediate effect without any notice

Dear Experts,

I were working in a Gurgaon based company since Dec. 2012 as Assistant Manager - A/cs. Company's CA (as a hired auditor) given me a another's company work to do its. I have already overload works, so, I consult our immediate boss (HOD) in this respect. They told me, that you continue your work only, I shall be give the CA's given work to any other person. But, CA's given work not done by HOD instructed person and so the auditor merely annoyed and started to threaten me.I gave to reply them that me the very burden of work, so I approached my boss and I did exactly as they instructed me. My boss has been accepted his instructions. Finally, the CA not considered our reply & situation and complained to the company director. 

One point to be noted : Work given by CA, another company.

The company director had been call me and without any enquiry about this they instructed me that not to come to the office from tomorrow onwards. I call our HOD about this, but they were not willing to talk with HOD. I go to the HR's office regularly two-three days to solve the issue. HR department and my HOD told me that write a apology letter to the Director, they will forgive you. But that did not happen and they did not agree to applogy to me and instructed to the HR that ask him for my resignation letter. I did not given any resignation letter and after some time stay in HR office came to my house. This is first issue in my seven years service in the company.

The company has not given me any termination letter and not made any my full & final settlement. The Company has been sent a Notice dated 03:02:15 regarding Full & Final Settlement through Speed Post. Then, I contacted to the HR Department but they are giving only 10 Days Salary (Last Worked Days) and balance Leave Encasement olny. No any Notice Period, No Gratuaty, No Bonus etc. 

The Company has not beng issue the appointment letters to any body, so, I have not also the appointment letter. But our salary totaly transfered by Cheques and Company Letter Heads. In this evidence first salary received in our Bank Statement clearly mentioned the company name with Cheque No. and Bank name. The Company pays the Bonus in cash.

The Company now obligation me that misbehaved with a senoir official of the company and used derogatory & offensive language. Please advice me that what to do in this regards?

Have you submitted any apology letter? If yes do you have the copy?

Did you write to employer that you have been instructed to not to come to office from tommorrow?

Who has sent notice for full and final settleemnt? You or the company? What is written in it?

 

You may show all documents on record to an able Labor Law Consultant/Service matters lawyer/Law firm and give inputs in person before you proceed further.
