Essential commodity act & ipc

A was charged, for storing / purchasing the few bags of rice, which sold by Fair price shop holder B scheduled to distribute to ration card holders by Government.  

Whether A be charged ( B could not be traced out by prosecution ) ?

  • (1)    u/s 406/420 IPC .
  • (2)    u/s 3/7 Essential Commodity Act (violation of control order made) read-with 406/411 IPC.

Whether A & B both be charged

  1. (1)    u/s 406/420 IPC .
  2. (2)    u/s 3/7 Essential Commodity Act (violation of control order made) read-with 406/411 IPC.
