Eviction of tenant

Hi Sir, 

My mother has a rental property in coimbatore. My elder brother used to collect the rent from tenant and made agreement in his name as property owner. My brother stop giving the collect rent to my mother.

When my mother asked for rental amount transferred to her account. My brother refused to do and told the tenants that he is the owner of the property by showing the orginal documents taken from mother and asked tenants to pay rent to him

Now my mother is in shock and don't know how to get the rental amount from tenants or evict the tenants. Could you kindly advise the procedure to vacate the tenants without rental agreement.

If your brother had entered into the rent agreement with the tenants by fraudulent means, your mother can issue a legal notice to them to vacate since she is the absolute owner 

After that she can file an eviction suit to evict them.
