Evidence of sms details from vodafone

Hi experts.. is there any legal way to get the details of SMS from vodafone or any other telecom service provider which can be presented as evidence of some incident or intention of the accused, even if both the mobile numbers were issued in the name of accused only..?

Further, specially in case where SMSs were exchanged long time back in the year in 2008 or 2009.

SMSes from 2008-2009 cannot be retrieved now if they had not been preserved within 1 year of sending/recieving them.

SMS details form part of Call Detail Records, which shall be preserved for 1 year as per the Unified Access Service Providers agreement under UASL. Please note that Voucher information of recharges of pre-paid would be kept for 6 months only.
