factories Act

Dear Sirs

One of the companies is engaged in Mining operatons and processing of the Excavated materials to make them saleable in the market. The crude excavated from the Mines can not be sold in the market unless they are processed. The processing is done with the help of machines and with in the Mines area. The workers are engaged for drying the crude first and then in the process Plant. The company is registered with District Industrial centre as SSI unit. The company is governed my Mines Act 1952 as the Mining lease  is granted by the DEpartment of Geology and Royalty is paid to the state Government regularly.

Questions

1. In such a case whether ESI act will apply to this company. THe Officials from Directorate of Mines safety visit periodically the mines and the operations.

2.As the Processing of the crude  take place inside the mines area , is it necessary for the company to register under Factories Act?
