Family pension

An unmarried daughter or son is availing pension of expired mother. Mother was an govt. employee. These children can avail maintenance from fathers' pension ? Father aiso a retired govt. employee.

Is this query reliable?  Who is availing mother's pension?  either daughter or son? If he/she is dependent, then only he or she may claim.  But as per your query, father is alive and he is pensioner.  so not possible.

Children are availing expired mother's pension

Now the query is as to whether they can get maintenance from the father, who is having only the pension as a source of income.

It all depends on the age of children and other properties in the mother's name and their name and need for such maintenance.

If the father nominates any of his legal heirs, depending on such eligibility criterion, they may receive the pension of such deceased father.

If a mother's pension is sufficient for maintenance as of now, for maintenance such children may not be eligible to legal claim from the pension of living father for their maintenance.

"These children can avail maintenance from fathers' pension" How is that the children are availing of maintainance from the father? Moreover, it is impossible that both the children are getting family pension; as per extant norms only one of them can get family pension depending on their respective eligibility.
