denial of s*x is something which no proof is possible, s*x is something which happens between the four walls of a bedroom only between husband and wife, thus the statement of husband or the wife, under oath will be proof enough of denial of s*x, supported by secondary proofs such as statements by the other members of the family, about the kind of relationship existing between the two, no children, etc. until the statement is not defeated in cross examination, this is proof enough Though the husband and wife may live under the same roof or in the same room also, but there may not be a cohabitation between both for years together and this may be due to various reasons including just a mere ego problem or into some other personal life problems namely adultery of any one of spouse, etc. Thus on an affidavit before the court, the reason for non-cohabitation may also be stated to add strength to their case.

for your kind information ,there is no word impotence for women /used any where in law or in other lexicon. to establish the cause of s*xual dysfunction, a doctor or a s*xual therapist need to ask questions about your medical ,s*xual and social problems. If the problem of a woman is related to pain,  lack of hormones, depression or problems like diabetes,B.P. might  also alleviate symptoms of dysfunction . for some women menopause is also a cause for dysfunction. fear of pregnancy or any infection which cause pain at that time also cause of dysfunction.

talk with your partner and approach a therapist together if you can. don't be embarrassed . many people experience s*ual dysfunction   and there are ways to get help

regards.

I respectfully disagree with Ms. Madhavi Latha in her opinion about impotency in respect of females, she may visit the concerned law books once again to get clarified.  Impotency is impotency you may brand it on any any name that suits you, but there is a definition about female impotency in the law.  If the querist does not want to disclose the basic facts here he may not get a proper guidance for his query/problems.

T. Kalaiselvan, Advocate (Advocate)     29 December 2013

A few excerpts about female impotency:  Impotency is ordinarily said to mean an incapacity physically and mentally to have s*xual intercourse.  The court are of the views that partial intercourse would not amount to consummation of marriage and if the wife is not capable to participate in the performance of s*xual intercourse to the fullest extent,it will be established in law that she will be deemed to be impotent.  It means inability to have normal s*xual intercourse, it may be due malformation of genital organ.  A defect in the female organ which makes normal s*xual intercourse not possible shall come within the definition of impotency.  The incapacity of conjugal intercourse, which is one of the objects of marriage, is termed as impotency.  Further, a party is impotent if his or her mental or physical condition makes consummation of marriage a practical impossibility.  The condition mus be one, according to the statute which existed at the time of marriage and continued to be so until the institution of the proceedings.  There are many more incidences to cite the female impotency, considering the lengthy narrations, I restrict to the above alone.
