Filing one more case in lower court on different ground

I filed divorce petition in 2011 on cruelity and desertion , later my wife filed petition for conjugal rights in the year 2012, later she proceed to abroad in year 2013 sept. My divorce petition got dismissed in the year April 2015 the leaned judge written in the order copy like I need to set aside the rcr decree , rcr is an exparte decree.I have filed an appeal in the high court ap, but two days back I withdrawal appeal, and I am planning to file a fresh case as no cohabitation after rcr decree. Please advice me am I on right track
