When Person knows that a crime is happening and he did not stop it or he did not take any necessary Precautions to stop the crime. Tough he has the capacity or power to stop the crime.

What action can be taken on such persons? Under what sections he is Punishable?

u/s 43 Cr.PC, a private person can arrest the accused and produce him before police. but failure in doing so is no offence.

If the person was protector and that is his responsibility to stop the crime to continue.
 And him self saying that the crime is going on.

Then Under what sections he is Punishable?

He can be punished for violation of his duty under the provisions of law under which duty was assigned to him. for more accurate answer plz clarify the relations between victim and the protector.

a non stopable crime can be punished ahgaisnt police offier witness under ipc 11c indian evidnece act also but it shoud necessary procecutred  , here the moral turpatide question can not arise known to me , the person in violved under truth facts act of british empire sytem also can forced for tagging.

                                              He is wilfully neglecting his duties and is liable to be suspended under sub-Rule(1) of Rule-10 of the Central Civil Service(Classification,control & appeal)Rules,1965.
