fDear querist,

Interim maintenance in DV can be granted on filing of case or after appearance of opponents.

Generally application u/s 23  as well as final order u/s 18 of Protection of Women from Domestic Violence Act, 2005 is considered and directed to pay interim maintenance of aggrieved person.

However, it may vary from case to case, it is advisable to consult your lawyer who is well aware about facts of the case, an able, competent and intelligent enough to satisfy your query/ question.

What is the advise / answer of your tutor ???

Dear Advocate it all depends from case to case as if the Ld. MM feels prima -acia that a maintenance be granted as an interim measure he will allow it at any stage of the matter pending in the court it is a discretionary power of the Ld.court to provide financial help if it is needed urgently to maintain the economic status-co of the applicant as to what she was enjoying by living with her husband.
