Gratuity

Sir, I am 61 years old now.  I joined a partnership firm on 17-Oct-2007 and my services were confirmed in  April 2008, after completion of probation period.  As of June 2012, I am completing 4 years & 8 months (without any loss of pay).  Is the gratuity calculated from the date of joining or from the date of confirmation.  Please clarify.

I have a query regarding "eligibility for gratuity". Because I’m already resigned from the organization on dated 02/02/2012 but worked till 05/04/2012.  

1) I have joined this company 05th August 2007 till 05.02.2008 on probation period as a IT Manager.

2) I got permanent letter on dated 06th Feb 2008.

3) I have the resigned the organization 02nd Feb 2012 and I have taken Five days leave with permission of management.

4) Worked till 05th April 2012 without any break.

 

My question is I’m eligible for gratuity? If I'm eligible so what are procedure i have to complete and whom to approach.

 

So I’m expecting proper guidance and advice.

1. If you have joined in the age of 61 as per Law of Land you are not eligible for any gratuity.

2. If you are a contractual employee then No gratuity.

3. If you are a permanent employee then you are eligible from date of joining.
