Great grandmother property uncle is not willing to give

how to go on partition if one do not have land documents ?

my uncle has taken all the land documents from our ancestral home after the death of my grandmother and now he is not willing to give it . his family is abusive and will do anything to keep all the property in his hand .

he has illegally sold many plots and making agreement and sale deeds for rest property .

can partition suit be filled, if I do not possess any documents of property .

can court summon my uncle to produce these documents ,

can court ask him to vacate the ancestral property till matter is resolved so that he cannot use the property and he cannot illegally sell the property . what I want is that court may take all the property under itself till this dispute is over and whatever land is sold is given to rightful owner and my uncle may be punished for fraud attempts .

kindly help .
