Section 21 of IPC defines a public servant and everyone who is a public servant has to perform his duties. A public servant can be booked under Section 353 of IPC. This section says that anyone who assaults or uses criminal force to someone being a employee within the execution of his duty per se employee, or with intent to stop or deter that person from discharging his duty per se employee, or in consequence of something done or tried to be done by such person within the lawful discharge of his duty per se public servant, shall be chastened with imprisonment of either descripttion for a term which can touch 2 years, or with fine, or with each..
A writ petition under 'Mandamus' - "WE COMMAND" can be filled. It is issued to enforce the performance of the public duties by the authorities of all kind. The only thing which has to be kept in mind is that the action should be purely of public nature.
