Mohini (Home maker)     12 June 2016

Haven't paid my maintenance as an owner.

I live in a society which is registered in 1990 and the maintainence is Rs 2500 per month.I haven't paid my maintainence for the last 6 months as the Lifts and terrace are in really bad condition.

I live in third floor and after that there is terrace..Water is seeping into my house creating major issues..Recently they renovated the terrace but in vain the leakage still persists.

The lift is in such a dangerous condition that it can fall anytime.

Can i stop paying them maintainence to undertake the terrace work myself as they are not carrying out properly and lift continues to be bad shape as usual ?

What are rights avaiable to me as a owner  and am i right in doing the above?

Please do not expect such guidance from this forum, as experts advise members first to perform your duty and then fight for your rights.

If the maintenance is not paid, what can you do if they disconnect power or do not provide information forcing you to file a case yourself.

In a society, as several persons with several attitudes live together  with families, and homely peace is the best we can get in the world, we should adjust and compromise and get things done in amicable way and the others should expresss more concern for the incovenience you are facing. Please do not misunderstand this as moral lesson, but take it in right perspective.

Sir, It is illegal to stop payment of maintenance, you may stand to lose your membership. The society is responsible for the repairs to lift and terrace Leakages. You may take legal action, but in no event stop payment of maintenance. Good luck, Kishor Mehta
