Wife filed dowry case U/s 498A IPC only then Police filed charge sheet U/s 3 & 4 of Dowry Prohibition Act and 498A IPC.
In written complaint of wife to police says that wife's parents gave to wife Rs.2,00,000/- cash and 900 grams gold and Rs.80,00,000/- worth land. Whereas the police say that the said property is given to husband by the parents of wife (no supporting documents are submitted along with charge sheet).
In some other case the wife filed affidavit in Supreme Court saying that the said properties (Rs.2,00,000/- cash and 900 grams gold and Rs.80,00,000/- worth land) are given to the wife as per wife's family tradition as Sridhan Property.
In this will section 3 and 4 of Dowry Act would be maintainable.
