Dear all,
Divorce petition was filed by Husband and in the fourth hearing wife has given only " vakalatnama " for divorce case and same was accepted by judge and now wife is firm on her consent for divorce but not give any WS and at same point Husband with a motive of prolonging the case and to give trouble to wife now tells the court that he is not pressing the divorce application and wants to withdraw petition because he has a criminal proceedings against him and husband tries to move the wife side to withdraw criminal case against him and so uses the trick of withdrawing the petition.
1) So can he withdraw Divorce petition after only filing of vakalatnama by side of wife advocate.
2) and no written statement was filed for till now
3) Court can order for divorce to wife after ws
4) And not allowing the husband to succeed in his motive
pls suggest.
