Ipc 380 theft case

Hi,

Few months back a theft occured in my house and we lost some gold ornaments.Finally police caught accused and we got back our gold.

Now the case is in court,what happens if the court case is lost?

What do you mean by "court case is lost" 

you are mentioning that a theft happened in the house that belongs to you.

the police caught and arrested the accused and found your belongs, in this case gold.

because this falls under Theft under IPC a case will be filed in court and the accused , here the thief  arrested by police, if found guilty will be punishable not exceeding 7 years of imprisonment and shall also be liable to fine.

The question is that the stolen properties have been recovered and handed over to the original owner legally then the offence is proved, may be accused may be acquitted if the court decides that the charges against him have not been  proved beyond doubt, however your items will remain with you.

I got back my gold from police itself not from court,than also is it safe?
