Hi ,

      Honestly i just wanted to know the reprecussions of not following notice period even though i have been provided salay for the mentioned  period  about 12 days when i was or is on leave on medical grounds, simply this mudslinging would not help me at all , i just wanted sme guidance regarding this matter from experienced or somewhat experience professional knowing the limits and what would be my next step if i tender my rsignation for the same, will i have to return the money added with 1 month salary as there are no conditions mentioned in offer letter of providing salary in lieu of notice period. Even though a lot of details were asked which i am not sure as an employee i can provide having joined for less than 2 week anyway help is always appreciated.

Dear Mr. Subhrashis Dey, 

The employee can not be forced to serve against his/her wishes.

The employer's private T&C that are violative of of applicable enactments, statue, instrument of law are VOID.

The notice period/pay  does not seem to be applicable in your case.

 

The employer is under obligation and employee is withiin his/her rights to supply correct FnF statement showing computation of earned wages till LWD/leave encashment/leave adjustment/bonus/reimbursments/incentives/OT as applicable amd as eligible and adjust notice pay and arrive at final amount payable by employer or by employee..............

As notice period/pay  does not seem to be applicable in your case, it must not be compuited in FnF statement.

Employee can reject to accept incorret FnF statement/settlement.

  

In your case the leave as per eligiblity may be computed/adjusted as per leave rules/policy of the establsihment or enactments that provided superior benfits.

 

If you have availed sick leave beyond your eligiblity then employer may treat is as LWP and adjust in correct FnF statement/settlement..............or grant waiver as per its sweet will.

You may relate with West Bengal Shops & Estbs Act: 2: (2,4,5,10,15), 4,11,12,14 and leave policy of the establishment.

The employer has paid on due date for previous months.

Post resignation; the employer should settle  on LWD in case the notice is given by employee, or say within next 3 days or by usual pay day.

Take help of  IT/ITeS employee's unions/employee's unions/Trade unions, elders of the family, competent and experienced well wishers and apply your skills of reasoning/pursuasion,perisitence,negotiations to resolve the matter in your favor.

 

There are many threads at LCI by employees that have resolved the matters by reasoning with designated HR person and escalalting to good offices of employer; appointing authortiy/MD/CEO, or with help of Greivance Redressal Committee, or thru IT/ITeS employee's unions/employee's unions/seassoned Trade union leaders...............

Employee or anyone should avoid sending personal details on online portals and attaching copies of any documents be it employment related say;    offer/appointment letter

 

If at all any doc is required employee should erase the names, logo etc to maintain the confidentiality.
