the apartment we live in consists of 40 flats.. 36 legal and 4 illegal.. out these 40, 32 are 2bhk and 8 r 3bhk. i live in 3bhk.
the association has decided maintaince on sqft basis. i am opposing and suggested fixed price since every one is using the same common resource but majority is not agreeing(all 3bhk are supporting me)as majority is 2bhk
below are my questions
- illegal flats have undivided share.. is that legally correct?
- can association be unfair(within the limits of by law) in the name of majority?
- association has not encountered any expense in sqft over the past 2 years
- what is my legal ground to fight this unjustice in bangalore?
