I’m Venkat Reddy from Telangana State. We are having common Property (some VASTE land in 10 Survey numbers and some Agricultural Land in 8 Survey numbers) at my village. We All are equal shareholders in each survey number and everyone has their own Patta/Katha Passbooks and documents etc... But now they sold-out their share of VASTE land survey numbers. Now As per registration record they are not the owners of the property now. (Agriculture land in other survey numbers which is also not divided as per survey numbers extent, but we took the position by mutual understanding of our fore fathers and continuing the same from last more than 100 years till now). Since the said property not divided, we asked our people to get positioning, they said their share already been sold out(VASTE Land) and they don’t want to come in VASTE Area of Land. So, from last 2years we are doing agriculture and cultivating some extent irrespective of survey numbers and took the position in one side of the total property within our limit of extent
Now they are occupying some extent of the land from which we developed and cultivating from last 2 years saying reason that they have not given the possession to the BUYER. I have approached to all of our co-owners of land to get divide the total land (VASTE and Agriculture) as per survey number partition, but they denied it. Since they already sold out, as my father is un-educated and alone living/forming in village, Please give me some suggestion and help how to proceed to get partitioned. The BUYER still now not yet took the possession from last 3 years. Now we want to take the possession in one side. More over VASTE land we already given the Sale of agreement in the year of 2013 and the agreement was lapsed we tried to get the registration to BUYER but he didn’t registered. Now my Co-Owners are disputing and not allowing for partition and possession in one side of total land.
I Approached to MRO but he denied to take my application and he told that i need to go to Civil Court.
Please help me, as I’m working in private company in Bangalore. if we file a case how to proceed and where to file. Can we get an Injunction order saying that until it has partitioned no one will have right to enter in the disputed land.. Can we get this Order and if yes how long it will takes to get this order. If i file a case will it be impact on my Professional career. please suggests.
