Laws relating to construction of buildings

Hi all.

here's my query:

XYZ is the owner of a piece of land in Bangalore. It has been converted from a non agricultural land to an agricultural land. He is now giving the land on lease to ABC company after constructing a building on the same which will be used by ABC Company as their office. Before the lease agreement is signed by the two parties, what are the relevant documents that ABC Company should verify regarding the construction of the building which will prove that all the legal requirements have been met with regarding the construction aspect and all the necessary certificates have been acquired... for eg. occupancy certificate, building licence etc.  I need to have a comprehensive list of all the legal documents and certificates required in this case.

property Extract. Document which shows how the seller got tittle over the property. 13 years exnumbrance certificate to know whethere is any encumbrance on property. Tax Paid receipts. NA order. list of other coparcenrs. whether it is an ancestral or self acquired property it is to be looked into. Entire property card so it can be ascertained that how the seller acquired the tittle. After verifying all the documents to clear the doubt if any body has got share in the property, paper notice is necessary.

Company may verify the Report on Title issued by XYZ"S Advocate or Company may get the title verified from their lawyer.. The various permissions granted by competent authority in terms of usage of building like B.U permission( Building use), Plans duly approved by Corporation or competent authority, Latest Tax bills, N.A permission and conditions stipulated in N.A permission may also be examined. Related searches from revenue and sub-registrar of Assurances may also be obtained so as to ensure that there is no litigation with respect to the land. In such cases, lesses are also joined as parties. Further, any other permission which is required to be obtained as per laws prevailing in Karnataka may also be verified since such laws vary from state to state. You may also obtain a Declaration or confirmation from XYZ that the land has a clear title and that there are no charges, encumbrance or litigation on the said property.

You should check the following documents:-

1) Ownership/Title documents.

2) N.E.C. for th elast 13 years.

2) Agricultural to N.A. conversion letter/certificate

3) Building Plans approved by the competent authority.

4) Occupency certificate issued by the competent authority.

5) Any other permission if required in Karnatka.

which law or book do i refer to for getting an answer to the question? is there any law that specifically talks about the requirements of construction?

The law relating to the development and construction of buildings differ stae to state, definately there wil be a law in Karnatka also. You should check that one, you can obtain knowledge about this from the office of town planner office.
