Pls help me in understanding what is meant by legal custody of child? can i claim it? if yes under which section?

The court will not grant you the custody of a 8 m old kid. However, you can get visitation rights.

I will definitely comply that. i just want to know that can i get overnight visitation when my son become 3-4 yers old?

According to The Hindu Minority and Guardianship Act, 1956 mother wil be the Natural Guardian til the age of 5 yrs. after the completion of the respective period you can get the custody of the child by following the statutory procedure.
