Dear Sir, My Aunt passed away leaving a will nominating me (her nephew) as her inheritor. I have initiated class II legal heir procedings in a civil court. In the meanwhile a person has forcefully encroached my Aunt's property. My lawyer's advise is not to raise a legal action against the encroacher, as it may affect the legal heir process adversly. The process started about 4 months ago and it is still underway.It is expected to last another 6 months.
Given this situation : 1) Should I restrain from raising legal action against the encroacher ? 2) What precaution should I take , so that the encroacher does not pawn / sell or do any other activity with the land/property ? 3) Once I get the legal heir what should I do next to evict the encroacher?
