LIABILITY MORE THAN CONTRACT VALUE

LIBBILITY CLAIM MORE THAN CONTRACT VALUE  -  IS IT TENABLE / LEGAL

continuing on this 

my present contract is silent on any Liability limits, i.e there  is NO CLAUSE ON LIABILITY

NOW say   in case of  any  dispute , can the other party PUT A CLAIM which is more than the contarct value OR i.e the amount I am eligible to earn thru the Contarct

Dear Mr. Vijaynarayan,

Yes, other party may claim damages more than the Contract value, and, moreover, it depends upon the nature of Contract and extent of loss incurred by the other party. But, Legally, he can claim more amount than the contract value, if the contract is silent on the damamges part and he proves that his loss is irreparable loss and much more than the contract value.

Thanks for the response.

I do have a soft point here , i.e the other party has to PROVE his damages which will again take a DISPUTED ROUTE
