Man acquitted of false dowry case: court orders fir against

MAN ACQUITTED OF FALSE DOWRY CASE: COURT ORDERS FIR AGAINST WIFE, FAMILY FOR FILING FALSE CASE; REJECTS PLEA FOR ALIMONY

Mysuru, Dec. 10- The Third Civil and Judicial Magistrate First Class (JMFC) Court has acquitted a man against whom false dowry harassment cases were filed by his wife and her family. The Court also ordered an FIR against his wife and family for filing a false complaint.

Three years back, Faisal Ahmed Khan, a resident of Mysuru had married Nazia Asma Gaffar, daughter of Abdul Gaffar Sharif and Asib Khanum. Later, Nazia had lodged a dowry harassment complaint against Faisal and his family members at the Fourth Civil Court (Senior Grade) and had also claimed maintenance at the Principal First Civil Court and JMFC Court.

After the cases were filed, Faisal came to know that Nazia had married her lover in 2003 at the Sub-Registrar Office and she and her family members had suppressed this information when she married Faisal. Later, Faisal collected information about the marriage and registered a private complaint, along with evidence, against Nazia and her family at the Third Civil and Judicial Magistrate First Class Court.

Hearing the case, the Court examined the evidence and ordered the N.R. Police to register an FIR against Nazia and her family and rejected the dowry harassment case filed against Faisal Ahmed Khan and his family.

Meanwhile, all the accused in the case surrendered before the Court and had obtained bail. Since Nazia had not appeared for the Court hearings since one-and-a-half years, her plea for maintenance was dismissed. She had claimed alimony of Rs. 20,000 per month and had appealed to the Court that the Rajivnagar house (near Kuvempu Circle) owned by Faisal, in which she was staying, must be given to her along with a permanent compensation of Rs. 57,46,000. She had also urged the Court that Faisal and his family members should not trouble her.

Listening to the arguments, the Court dismissed her plea and ordered the Police to give the house back to Faisal’s possession. Faisal’s family was asked by the Court to seek Police help in case there was trouble from Nazia’s family. Faisal and his family were represented in the Court by Advocate S. Arunkumar and Rashmi Arun of Praghabi Law Associates.
