Mandatory Trial

Greetings Experts!

As well all are aware, a trial is not mandatory in civil cases. But I would like to know if there is any sort of civil case in which trial takes place??

It depends on the facts of the case and Trial is a rule, and depending on facts, the court may entertain if parties agree for delivering judgment baing on documentary available.  This exemption is at the discretion of the court, after such prayers from parties and an exceptional case.

As per your query, let me tell you that civil cases involve conflicts between people or institutions such as businesses, typically over money. A civil case usually begins when one person or business (the "plaintiff") claims to have been harmed by the actions of another person or business (the "defendant") and asks the court for relief by filing a "complaint" and starting a court case.

The process of the trial of a civil case and its different stages is given in the Code of Civil Procedure 1908 (CPC).

As per section 9 of the civil procedure code, the court shall have jurisdiction to try all suits of civil nature excepting suits of which cognizance is either expressly or impliedly barred.
