6 NBWs were issued by court in one state to be executed in other state in 138 cases . Appeal was made in high court & in 4 cases high court had issued order allowing counsel to be present for accused. High Court asked accused to submit undertaking for the same. 4 NBWs are recalled. In case of other 2 similar cases court High Court has issued different order saying that NBW not be executed till certain date. Accused shall present themselves in front of magistrate till certain date. On their personal prescence NBW shall be recalled.
Why High Court has issued different order ins similar cases. Accused are not in position to appear in present of Magistrate. What can be done to recall the NBW?
